この利用規約（以下「本規約」といいます。）は、Kabosu Image Converter（以下「本サービス」といいます。）の利用条件を定めるものです。利用者の皆様（以下「ユーザー」といいます。）は、本サービスを利用することにより、本規約に同意したものとみなされます。
第1条（適用および同意）
1. 本規約は、ユーザーと運営者との間の本サービスの利用に関わる一切の関係に適用されるものとします。
2. ユーザーは、本サービスを利用を開始した時点で、本規約のすべての記載内容に同意したものとみなされます。
第2条（禁止事項）
ユーザーは、本サービスの利用にあたり、以下の行為をしてはなりません。
- 法令または公序良俗に違反する行為（児童ポルノ、わいせつ画像などの違法な画像データのアップロードを含みますが、これに限りません）
- 犯罪行為に関連する行為
- 本サービスの内容等、本サービスに含まれる著作権、商標権ほか知的財産権を侵害する行為（他人の著作物を無断でアップロード・変換する行為を含みます）
- 運営者、ほかのユーザー、またはその他第三者のサーバーまたはネットワークの機能を破壊したり、妨害したりする行為
- 本サービスに過度な負荷をかける行為（DoS攻撃、短時間での大量アクセス等）
- 不正アクセスをし、またはこれを試みる行為
- その他、運営者が不適切と判断する行為
第3条（サービスの変更・停止・終了）
運営者は、ユーザーに事前に通知することなく、本サービスの内容を変更、一時停止、または提供を完全に終了することができるものとします。これによってユーザーに生じた不利益または損害について、運営者は一切の責任を負いません。
第4条（権利の帰属）
1. ユーザーが本サービスにアップロードした画像の著作権は、ユーザーまたは正当な権利者に留保されます。
2. 本サービスを構成するプログラム、デザイン、ロゴ等に関する知的財産権は、すべて運営者または正当な権利者に帰属します。
第5条（免責事項）
1. 本サービスは現状有姿（「AS IS」）で提供されます。運営者は、本サービスに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラーやバグ、権利侵害などを含みます。）がないことを明示的にも黙示的にも保証しておりません。
2. 運営者は、本サービスの利用に起因してユーザーに生じたあらゆる損害（画像データの消失・破損、変換後の品質劣化、サービスの中断・停止等を含みますが、これらに限りません）について、一切の責任を負いません。また、お問い合わせフォームの利用によって生じた損害についても、運営者は一切の保証を行いません。
第6条（損害賠償）
ユーザーが本規約に違反し、運営者に損害を与えた場合、運営者は当該ユーザーに対して損害賠償（弁護士費用等の合理的な費用を含みます）を請求することができるものとします。また、法令違反や犯罪行為が疑われる場合は、警察等の公的機関へ通報する場合があります。
第7条（利用規約の変更）
運営者は、必要と判断した場合には、ユーザーに通知することなくいつでも本規約を変更することができるものとします。変更後の規約は、本サイト上に掲示した時点で効力を生じるものとし、ユーザーが変更後に本サービスを利用した場合、変更後の規約に同意したものとみなします。
第8条（準拠法・管轄裁判所）
1. 本規約の解釈にあたっては、日本法を準拠法とします。
2. 本サービスに関する一切の紛争については、訴額に応じて仙台地方裁判所または仙台簡易裁判所を第一審の専属的合意管轄裁判所とします。
第9条（言語）
本規約の正本は日本語版とします。本規約の英語版（翻訳版）が提供されている場合であっても、これらは参考として提供されるものであり、日本語版と英語版の間に解釈の相違がある場合には、日本語版が優先して適用されるものとします。

These Terms of Service ("Terms") govern your access to and use of Kabosu Image Converter ("the Service"). By using the Service, you agree to be bound by these Terms.
1. Applicability and Consent
By accessing or using the Service, you are deemed to have agreed to all provisions of these Terms.
2. Prohibited Actions
When using the Service, users are prohibited from engaging in the following acts:
- Acts that violate laws, regulations, or public order and morals (including but not limited to uploading illegal images such as child pornography or obscene materials)
- Acts related to criminal activities
- Acts that infringe on the copyrights, trademark rights, or other intellectual property rights contained in the Service or belonging to others (including unauthorized uploading and conversion of others' copyrighted works)
- Acts that destroy or interfere with the functionality of the servers or networks of the operator, other users, or third parties
- Acts that place an excessive load on the Service (e.g., DoS attacks, massive requests in a short time)
- Unauthorized access or attempts thereof
- Other acts deemed inappropriate by the operator
3. Modification, Suspension, and Termination of Service
The operator reserves the right to modify, temporarily suspend, or completely terminate the Service at any time without prior notice to the users. The operator shall not be liable for any disadvantage or damage incurred by users as a result of such actions.
4. Intellectual Property Rights
1. The copyright of the images uploaded by users to the Service is retained by the user or the legitimate right holder.
2. All intellectual property rights related to the programs, designs, logos, etc., constituting the Service belong to the operator or the legitimate right holder.
5. Disclaimer
The Service is provided "AS IS" without warranty of any kind. The operator shall not be liable for any damages arising from the use of the Service, including but not limited to loss or corruption of image data, degradation of quality after conversion, or interruption or discontinuation of the Service. Furthermore, the operator provides no warranty and assumes no liability for any damages arising from the use of the contact form.
6. Compensation for Damages
If a user causes damage to the operator by violating these Terms, the operator may claim compensation for damages (including reasonable attorney's fees) against the user. Furthermore, if a violation of law or criminal activity is suspected, the operator reserves the right to report the incident to law enforcement or other public authorities.
7. Modification of Terms
The operator reserves the right to modify these Terms at any time without prior notice if deemed necessary. The modified Terms shall become effective upon being posted on this website. By continuing to use the Service after the Terms have been modified, users are deemed to have agreed to the modified Terms.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Sendai District Court or the Sendai Summary Court, depending on the amount in controversy, as the court of first instance.
9. Language
The original version of these Terms is written in Japanese. Even if an English translation is provided, it is for reference purposes only. In the event of any conflict or inconsistency between the Japanese version and the English translation, the Japanese version shall prevail.
